Dear folks- I am opposed to the Hultquist proposed division of the Tract with a three acre+ Public Use Easement (PUE) for the following reasons: The Municipality bought this land, and other PUEs in the Hultuist subdivision, from the previous owners for $ 140,000. The deeds all read that this entire acreage shall be reserved for public use "in perpetuity." The Hultquists unsuccessfully tried to get the Platting Board to terminate this PUE when they submitted their first proposed plat. The Platting Board, however, wisely kept this land reserved for public uses. Now the hultquists are trying again to encroach on or even terminate this PUE, and convert it into two new lots, with no compensation to the city. Local citizens have created and maintained a nice hiking trail, with other amenities, along the northern border of this PUE. With the present two lot proposal, at least one of the lots will have a driveway that cuts right across this trail. It will also run down the entire length of the PUE, destroying any public uses that are planned, such ass a picnic area with tables, a walking labyrinth, other connecting trails, etc. I feel that the Hultquists have chosen a very irregular process (the "short plat") that is shielded from any meaningful public input. The members of the Platting Board have a fiduciary duty to the citizens of Anchorage to honor the &"in perpetuity" terms of the PUE deeds, and preserve this three+ acre PUE for public use, by denying this proposal. If they see fit to dishonor their fiduciary duty, then at the very least the Platting Board should rule that a plat note needs to be added, letting the new owners know that the majority of their lot, and possibly their entire lot, is subject to continuing public use, including building out and maintaining public structures and trails across "their" property. I strongly urge the Platting Board members to protect the public's continued use "in perpetuity" of this PUE, according to the terms of the contracts/deeds, by disapproving the Hultquist's new application. Otherwise, the Platting Board will be abetting the Hultquist's efforts to appropriate this land for their personal profit, that is tantamount to a "without compensation". Thank you.

This is a relatively new subdivision formed in 2020/2021 and I am not certain whether it complies with the 48 month requirement of AMC 21.03.200.B.2.iii(A). Its justification under the applicable Zoning Criteria is conclusory at best. As someone living in the neighborhood, my concerns are 1. The presence of ALL existing easements should be confirmed (This was an issue in the prior Subdivision Approval). 2. I believe there is a Long Standing Public Use Trail across the property comparable to the Stewart Homestead Trail whose continued existence should be confirmed. The best course of action would be to have the Landowner follow the non-abbreviated, normal Platting procedure. Thank you for your consideration.
