| Birchwood Council requests that the Platting Board deny the extension and variance proposed by the ASD. The ASD as well as some other entities seem to see theirselves as exempt from the standards other developers of property are held to via MOA Code and Regulations. This double standard has proved to have a negative impact with far reaching consequences in the past and at some point this has to be corrected. It is crippling to the timely and proper development of this local community and its residents. We fully support the reasons stated by both the CBERRRSA Board of Supervisors, whose members are appointed from each community council, as well as comments submitted by the Mental Health Trust regarding this case. My current health prevents my attendance at this meeting to argue and enforce all the relevant points supporting what we and others have noted. Thank you. | |

| On November 15, 2011 the Chugiak-Birchwood-Eagle River Rural Road Board of Supervisors unanimously approved a motion to recommend the Platting Board uphold the initial decision made for the Anchorage School District to fulfill their original obligation by building the roadway to urban collector standards. During the February 27, 2012 Road Board meeting the Chugiak-Birchwood-Eagle River Rural Road Board of Supervisors unanimously approved the following as a supplemental to their original motion, dated November 15, 2011. YOSEMITE DRIVE 1. THE MUNICIPALITY OF ANCHORAGE OFFICIAL STREETS AND HIGHWAYS PLAN CLASSIFIES YOSEMITE DRIVE AS A COLLECTOR ROAD 2. THE MOA DESIGN CRITERIA MANUAL DEFINES THE CHARACTERISTICS AND FUNCTIONS OF COLLECTOR ROADS; YOSEMITE DRIVE CLEARLY MEETS THOSE CHARACTERISTICS AND FUNCTIONS 3. TITLE 21 PLACES THE EAGLE RIVER HIGH SCHOOL SUBDIVISION WITHIN THE URBAN AREA AND IDENTIFIES THE TYPES OF ROAD IMPROVEMENTS REQUIRED FOR URBAN COLLECTOR STREETS 4. THE SCHOOL DISTRICT IS THE SUBDIVIDER OF THE EAGLE RIVER HIGH SCHOOL SUBDIVISION; IT IS NOT UP TO THE SUBDIVIDER TO ESTABLISH THE ROAD CLASSIFICATION 5. AS A SUBDIVIDER, THE SCHOOL DISTRICT IS BOUND BY TITLE 21 AND IS REQUIRED TO IMPROVE YOSEMITE DRIVE TO URBAN COLLECTOR STANDARDS 6. THE MINIMUM TRAFFIC VOLUME OF COLLECTOR ROADS IS 2,000 VEHICLES PER DAY 7. YOSEMITE DRIVE ALREADY CARRIES OVER 3,000 VEHICLES PER DAY 8. UNDER THE FULL DEVELOPMENT SCENARIO YOSEMITE DRIVE WILL CARRY BETWEEN 6,000 AND 10,000 VEHICLES PER DAY 9. GRANTING OF A VARIANCE FOR THE UPGRADING OF YOSEMITE DRIVE TO ANYTHING OTHER THAN URBAN STANDARDS IMPLIES THAT CBERRRSA WILL EVENTUALLY HAVE TO IMPROVE THE ROAD TO URBAN COLLECTOR STANDARDS 10. THE SUPERIOR AND THE SUPREME COURTS OF THE STATE OF ALASKA MADE IT PERFECTLY CLEAR THAT IT IS THE SCHOOL DISTRICT RESPONSIBILITY TO IMPROVE YOSEMITE DRIVE AS PART OF THE APPROVAL OF THE EAGLE RIVER HIGH SCHOOL PRELIMINARY PLAT; IT IS NOT CBERRRSA’S RESPONSIBILITY 11. IT IS UNFAIR TO ATTEMPT TO TRANSFER THE RESPONSIBILITY FOR THE IMPROVEMENT OF YOSEMITE DRIVE TO URBAN COLLECTOR STANDARDS FROM THE SCHOOL DISTRICT TO CBERRRSA, i.e., TO THE PROPERTY OWNERS IN EAGLE RIVER / CHUGIAK AREA 12. THE SCHOOL DISTRICT HAS SUFFICIENT UNENCUMBERED FUNDS TO IMPROVE YOSEMITE DRIVE TO URBAN COLLECTOR STANDARDS 13. CBERRRSA RESPECTFULLY REQUESTS THE PLATTING BOARD NOT TO GRANT THE SCHOOL DISTRICT REQUEST FOR A VARIANCE TO THE URBAN COLLECTOR STANDARDS FOR YOSEMITE DRIVE | |

| The Trust Land Office (TLO) manages two parcels of land adjacent to the subject road for the Alaska Mental Health Trust Authority. These parcels are both affected by this proposed time extension. It is not in the best interest of the Trust or the neighboring community to allow the Anchorage School District to continue to delay the required mitigation on Yosemite Drive. The TLO asserts that an additional extension is without merit and will continue to negatively affect the property interests of the adjacent lands and exacerbate impacts to public traffic flow and subsequent traffic safety. | |

| At the regularly scheduled 11/15/11 Chugiak-Birchwood-Eagle River Rural Road Service Area (CBERRRSA) Road Board Supervisors meeting, the Supervisors unanimously passed a motion to recommend that the Platting Board uphold the initial decision made for P&Z Case No. S11099-6 and require the Anchorage School District to fulfill their original obligations by building Yosemite Drive to full urban collector standards. | |

| Please allow the earlier decision of the board to stand. The School District and Municipality need to be held to the same (or higher) standard as any other developer within the municipality, including all considerations regarding timing and funding. In other words, poor planning by the school district and/or municipality should not be the basis for a time extension. The road either meets standards or not, and currently it does not. | |

| The March 2, 2005 Staff Comments for Case No. S11099-3 (Eagle River High School/Yosemite Drive) states, “The responsibility for upgrading roads to collector standard has been a community responsibility. As Yosemite is not in ARDSA, the upgrade of Yosemite Drive will be the responsibility of Chugiak-Birchwood-Eagle River Rural Road Service Area (CBERRRSA).” I have a clarification about the above statement. Developers are responsible for building CERLRTP-identified collectors within CBERRRSA and paying 100% of the associated costs. For example, the future extension of Oberg Road in West Peters Creek had been identified as a collector in the CERLRTP and the developer was required to build the road to rural collector standards and pay the entire cost. | |

| Yosemite Drive needs widening, curbs and all other features such as striping and lighting, to be in place before the school opens. Please do not wait until the school opens to upgrade Yosemite Drive. It is a safety issue, there no need for a daily traffic jam involving road construction and hundreds of students attempting to get to school. Please act now. | |
