I originally objected to the granting of this variance. However, after having discussed the matter with the Jensens, I now understand the nature of their variance request and fully support granting their request to allow the encroachment onto the setback.

The Huffman/O’Malley Community Council has no objection to the variance request Case #2011-063 to allow only the existing 4’ 4” encroachment of the residential structure into the setback.

We are the adjacent land owner to the east. We have lot 1 and 2, Cabin by the Creek, Block #1. We support the request.

We are the adjacent neighbors and can support the 4' variance request related to the existing structure. This structure was originally built into the setback. Any additional variance requests for further encroachment into the setback we cannot support. Any further/additional encroachment will have a detrimental effect on our property value and potentially lead to other unintended consequences. Neighborhood codes and zoning restrictions are for the benefit of all residents and were in place when each of us purchased our properties; at the time of purchase, we each bought our homes with knowledge of the restrictions and an understanding of how they would limit our future use of the properties.
