​Terms and Conditions

By submitting an application to the People Mover Local Art Initiative, you acknowledge and agree to the following:

Eligibility

You must be an artist currently living in the Municipality of Anchorage, or an artist living in Alaska with roots in or ongoing connections to Anchorage.
All submitted materials must be your own original work.

Limited License to Use Logo

Solely for purposes of enabling your submission, People Mover grants you a limited license to use of its logo (bus with heart) in your artwork.

Originality of Work

Submitted concepts must be original and not previously published, sold, licensed, or publicly displayed.

Final commissioned artwork must be created specifically for the People Mover Local Art Initiative.

Artist Responsibility

By submitting, you confirm that your work does not infringe on any copyright, trademark, or other intellectual property rights of any third party, or defame
or invade the privacy rights of any third party.

You agree to indemnify, defend, and hold harmless Anchorage People Mover from any claims to or arising from your work.

Rights to Submitted Materials

By submitting, you grant Anchorage People Mover permission to review, share, and reproduce your materials for any purpose.

Submitted materials may be used in print, digital, broadcast, and social media without additional​ approval from the artist.

Disqualification

Anchorage People Mover reserves the right to disqualify any submission that does not meet eligibility requirements, is incomplete, or is deemed 
inappropriate or offensive.

Nondiscrimination

Submissions will be judged without regard to race, color, sex, sexual orientation, gender identity, religion, national origin, marital status, age, or physical
or mental disability.

Commissioned Artwork and Intellectual Property

If selected as a finalist or winner, you will receive compensation in exchange for granting Anchorage People Mover full rights to and ownership of the
commissioned artwork, including the exclusive right to reproduce, adapt (as needed for signage specifications), publish, and display the artwork in
perpetuity. All commissioned works will be considered works for hire under 17 U.S.C. § 201.

Artists will continue to be credited as the creator of their work in all promotional materials, press releases, and public displays related to the project.

Independent Status

Participation in this Initiative does not create an employment, agency, partnership, or contractor relationship with Anchorage People Mover.

Release of Claims

By applying, you release Anchorage People Mover and the Municipality of Anchorage from any claims arising out of the use, reproduction, alteration, or
display your submitted or commissioned artwork, or failure to use or display your submitted or commissioned artwork; and expressly waive any rights
that might otherwise apply under 17 U.S. Code § 106A, except for the right of attribution.

No Obligation

Submission of materials does not guarantee selection, compensation, or use. Anchorage People Mover is not obligated to produce, display, or install
any submitted, selected, or commissioned artwork.

Governing Law and Venue

Any dispute arising from these terms and conditions is governed by the laws of the State of Alaska, with venue lying exclusively in Anchorage Superior
Court.
