Where can I come to make my fine payment, bring my Community Work Service verification or drop off paperwork for my other conditions?

Where can I mail my Fine payment, Community Work Service verification or other paperwork to fulfill my conditions?

If you mail information/payments I suggest you confirm we received it.  It is never safe to assume we did.

Do you take Credit Card Payments?

No, we do not have the capability at this time.  All fine payments should be in the form of Cash or Money Order. 

Can I fax my Community Work Service or other verification to you? 

Yes, please fax your information to 907-343-6482, attention: Pre-Trial Diversion.  If you fax information I suggest you confirm we received it.  It is never safe to assume we did.

Can I convert my Assigned Community Work Service to a Fine?

Yes, Community Work Service for the Pre-Trial Diversion program converts at $6.25 per hour.  For example:  40 hours of Community Work Service is equal to $250.00

Can I convert my Fine to Community Work Service?

No.

The Community Work Service office charges a $25.00 fee; you are required to have a slip to participate prior to signing up.  Please pick this slip up at City hall, Prosecutors Office. 632 W 6th Avenue, suite 210.

Can I get an extension for my fine or my Community Work Service?

There is no guarantee that we will or that we can extend your time.  To make a request for an extension of time please Email the PTD program at prosptd@muni.org

You took my fine out of my Permanent Fund Dividend.

The Pre-Trial Diversion program does not execute on the PFD.  We can only take your PFD if you have signed an Assignment of Rights form and provided it to us.

What is my next court date?

This date is located in your Pre-Trial Diversion Performance Agreement.  You may also contact the Alaska Court System at 907-274-8611 or you can look up your case status in “COURTVIEW” on the court website at http://www.courtrecords.alaska.gov/pa/pa.urd/pamw6500.display
You can determine your next court date by viewing the DOCKETS tab. If you fail to appear a Warrant may be issued for your arrest.

What time is my arraignment?

When the court is open, out of custody arraignments take place at 9:00 a.m. in the Nesbett courthouse.  The location is 825 W 4th Avenue.  Arraignments are held in courtroom B-1. 

Can you extend my court date?

No, we are not the court system.  We do not have the ability to change the court date that you have been given by the Judge.  If you want to change your court date you need to fill out a request and order form.  This form can be found at the Municipal Prosecutor’s office (632 W 6th Suite 210) or at the Nesbett Courthouse (825 W. 4th). There is no guarantee that the court will grant this request.

I do not live here or will not be in town on my court date.  Can I appear via Telephone?

This request must be made through the court system.  Please call 907-264-8611 to facilitate that request. 

I have a Bench Warrant for Failure to appear at my arraignment, what do I do?

If you need to quash your warrant you can fill out a request and order form.  This form can be found at the Municipal Prosecutor’s office (632 W 6th Suite 210) or at the Nesbett Courthouse (825 W. 4th). There is no guarantee that the court will grant this request. Your warrant will remain in effect until you have appeared in court.

OR

You may be able to be placed on the next available 9:00 a.m. arraignment calendar.  To do this you will need to go to the Nesbett courthouse (825 W. 4th). before 2:00 p.m. and ask them to place you on the next business day’s calendar.  Your warrant will remain in effect until you have appeared in court.

I was charged with Driving without Insurance and/ or Driving without a license.  I have obtained my insurance and/or my license; do I still have to come to court?

Yes, you need to appear at your arraignment.  Cases are reviewed for eligibility prior to arraignment.  If you are eligible, a Pre-Trial Diversion offer may be given to you at your initial arraignment.  Please report to the court at the date and time indicated on your Uniform Summons/Citation.  If you fail to appear a Warrant may be issued for your arrest.

If I have a suspended license, how can I find out what the requirements are to reinstate it?

I have problems with my Driver’s License out of State.  How do I get a hold of the DMV in the other state?

You may be able to find the DMV you are looking for at the following web site. If you can not try directory assistance for the State you are trying to reach.  http://www.dmv.org/

I was charged with Driving under the Influence, am I eligible for Pre-Trial Diversion?

No!

I have to complete a Defensive Driving Course, where can I take that?

I have questions regarding the impoundment of my vehicle.

The impoundment of your vehicle is a matter that is handled by the Civil Department of law.  The impound division can be reached at 907-343-4575.

What if I was offered Pre-Trial Diversion at court and I left before seeing the Coordinator?

You may not be eligible to receive Pre-Trial Diversion for failure to report to the Pre-Trial Diversion Coordinator as ordered by the Court.   Please appear at your next indicated court date or a Warrant may be issued for your arrest.

What happens if I do not comply with ALL of the conditions of my performance agreement with the MOA / Pre-Trial Diversion Program?

You are required to complete EVERY condition of the Performance agreement within the specified time period given.  If you have not performed ALL of the conditions, your case is subject to Reinstitution of Prosecution and may render you ineligible for any future participation or reassignment into the Pre-Trial Diversion Program.  If you are reassigned you could be subject to a re-assignment fee up to $250.00 and an increase in you Community Work Service Hours. If you have not completed your requirements it is imperative that you appear at your next assigned court date.  This date is located in your Pre-Trial Diversion Performance Agreement.  You may also contact the Alaska Court System at 907-274-8611 or you can look up your case status in “COURTVIEW” on the court website at http://www.courtrecords.alaska.gov/pa/pa.urd/pamw6500.display

I thought the charges were dismissed, why are they on my criminal record?

If you have successfully completed Pre-Trial Diversion we will file a dismissal with the Alaska Court System.  Because you were charged with a crime, there will always be a public record for this case and the charges will appear in your Criminal HISTORY.  A dismissed case should not appear in your Criminal CONVICTION history.

I left the Courthouse without being fingerprinted.  What do I do?

Please Contact the Department of Corrections Fingerprint Office at 907-264-0784.

I was arrested, how do I get my bail money back?

If the Judge did not exonerate your bail at the time of your arraignment you will have to fill out a request and order form.  This form can be found at the Municipal Prosecutor’s office (632 W 6th Suite 210) or at the Nesbett Courthouse (825 W. 4th). There is no guarantee that the court will grant this request.

I have been charged with a New Jailable Offense, what is going to happen to my
Pre-Trial Diversion case?

Your Pre-Trial Diversion case is subject to Reinstitution of Prosecution for a violation of your probation.  This applies even if you have complied with all of your other conditions.  When you are charged with a new offense the old case is reviewed and a determination is made as to whether it will be reinstituted or remain in the Pre-Trial Diversion program.  You should inform your PTD coordinator as soon as possible of any new charges.

I would like to participate in Pre-Trial Diversion, how can I get into the program?
