Title 21  of the Anchorage Municipal Code specifies that an annual administrative permit is necessary to operate a bed and breakfast.

Title 21 defines "bed and breakfast" to mean "a single-family or one unit of a two-family dwelling, excluding mobile homes, except in the R-5, R-5A district which is host/owner/operator of the enterprise occupied and offering overnight accommodations for which compensation is paid on a daily or weekly basis for no more than thirty (30) consecutive days, and which offers only one daily meal."
The permit is valid between January 1 (or the date of issuance) and December 31 of the following year.

An application for renewal shall be submitted no later than December 1 immediately preceding the expiration date of that permit.

Submission Requirements

The following are required submissions for an annual administrative permit to operate a bed and breakfast for either an initial application or a renewal application:

  • Completed application on form prescribed by the Building Safety Division.     
  • Proof of current business license: a State of Alaska business license can be applied for at the State Department of Commerce and Economic Development (see addresses) or online at the State of Alaska's Online Business License Service.     
  • A notarized statement certifying that the structure meets minimum life safety standards established by the Building Safety Division. A copy of the required statement, including the list of minimum life safety standards, is on the back of the permit application

    The following submissions are required only for the initial administrative permit or when a change to the structure has occurred.
  • A building floor plan showing the entire structure (all floors) drawn to an indicated scale. Guest rooms for the purpose of the bed and breakfast should be identified     

  • An as-built survey of the property or a site plan drawn to scale showing the general location and uses of structures, parking areas, signs, vehicular circulation, drainage, and property boundaries     
  • Signed copy of Administrative Site Plan Approval (for 4 bedroom establishments) or Conditional Use Approval (for 5 bedroom establishments). This can be obtained from the Department of Economic Development (see addresses)     
  • A Health Authority Certificate if the dwelling is served by an on-site sewer or water system, which can be obtained as follows:

    • For existing systems previously approved as a single-family residence:
      1. Obtain a copy of the certified "On-Site Sewage Disposal System and/or Well Inspection Report" for the system from the Department of Health and Human Services (see addresses).     
      2. Take a copy of this inspection report to the State Department of Environmental Conservation (DEC) (see addresses) who will issue a letter of approval if the system meets state requirements. If the system does not meet state requirements, a waiver of those requirements may be requested from DEC; however, there is no guarantee the waiver will be granted. The DEC has identified the following procedures to meet their requirements:

        For Category 1 Residences: those proposing to change the status of their water and waste water disposal (wwd) systems from single-family to light commercial status without altering the existing load (no increase in the number of bedrooms) on either system.
        • Copy of the On-Site Sewage Disposal System and/or Well Inspection Report
        • Copy of the as-built survey of the property which will need to include locations of all clean outs, monitor tubes, and wells. (NOTE: as-builts must be to scale.)
        • Copy of well log
        • Analytical lab results for coliform bacteria and nitrates (as nitrogen) from water samples taken in the previous thirty days
        • Complete MOA DHHS "Health Authority Approval Checklist" and MOA DHHS "Certificate of Health Authority Approval for a Single-Family Dwelling" or complete the State of Alaska, Department of Environmental Conservation, "Application for On Site Water and Sewer System Approval.” If the health authority approval is older than six months, a new adequacy test for the on-site wastewater disposal system will be required. (NOTE: All data collected during the adequacy test will need to be submitted for review. This data must be certified by and submitted under the stamp of a professional engineer.)

        For Category 2 Residences: those proposing to change the status of their water and waste-water disposal systems from a single-family residence to a light commercial status which results in additional demand on the water and waste water disposal systems. An example of Category 2 is: water and wwd systems sized for a three- bedroom single-family residence (1,000 gallon, two-compartment septic tank/private well) to be resized for an addition of one more bedroom (septic volume is increased to 1250 gallons and well is upgraded to Class C).
        • Engineering plans for the upgrade of the water and wwd systems will be submitted to the Anchorage District Office of ADEC under the stamp of a professional engineer
        • A waiver request, if needed, must be submitted as specified in the Waste Water Disposal and Drinking Water Regulations when the separation distance between the water system source well and the wwd is less than 150 feet
        • Copy of well log
        • Analytical lab results of water samples from the well (within the previous thirty days) for coliform bacterial and nitrates (as nitrogen

        The above information is required to obtain "Approval to Construct". Once construction is complete and all requirements have been met, an "Approval to Operate" can be issued.

      3. Submit both the DHHS Inspection Report and the DEC letter to Land Use Enforcement with the permit application for the bed and breakfast.

    For on-site systems for bed and breakfast located in existing duplex, provide State DEC "Approval to Operate" certificate. For new systems, obtain a permit from the State Department of Environmental Conservation (see addresses). Submit DEC certificate to operate the system to the Land Use Enforcement with the permit application for the bed and breakfast.
