Plat Notes and Covenants
Some subdivisions have "covenants, conditions, and restrictions," commonly called CC&Rs or subdivision covenants. These are private agreements between property owners, filed in the district recorder's office and made a part of the title to the land. The Municipality is not a party to these covenants and does not enforce them. If a property owner violates the subdivision covenants, the other parties to the agreement (the other property owners or a homeowners association) may enforce the covenants through a suit in the state district court.
The Municipality has the authority to enforce plat notes because they "constitute a restrictive covenant in favor of the Municipality and the public." (AMC 21.15.120.E) These restrictions appear on the plat - the document that actually creates the subdivision. Plats may be reviewed at the Permit Center (4700 South Bragaw), at the district recorder's office (550 W. 7th Avenue, suite 1200), or through the Department of Natural Resources' website.
