Appeals

Denial of a building permit, land use permit, flood hazard permit, or mobile home operating permit may be appealed to the Zoning Board of Examiners and Appeals under AMC 21.30.110.

Enforcement orders may be appealed to the Zoning Board of Examiners and Appeals under AMC 21.30.110.

Decisions of the  Administrative Hearings Officer may be appealed to Superior Court.

There is no appeal process for nonconforming determinations, although a determination may be revised if new evidence is presented.  In most cases, the remedy for an unfavorable nonconforming determination is a variance from the Zoning Board of Examiners and Appeals.

There is no appeal process for use determinations.  The  Zoning Board of Examiners and Appeals may permit a use if it determines “that the structure, or use of land or a structure, is similar in character to a permitted use in that use district,” but this action is separate from the use determination process.

In most cases, decisions of the  Platting Board and the Planning and Zoning Commission may be appealed to the board of adjustment.

Decisions of the Zoning Board of Examiners and Appeals may be appealed to Superior Court.

There is no appeal process for decisions of the administrative official unless a decision results in the denial of a permit.
